This Privacy Policy applies to the manner in which Matex Net Private Limited (hereinafter referred to as Matex) collects, uses, maintains and discloses information from all users of its website / mobile application in connection with the products and services offered by Matex.

At Matex we recognize the importance of privacy and confidentiality of personal information.
Matex is a corporate entity engaged in providing among other products and services an online procurement and sale platform in the name and style of purchasequick.in (herein after mentioned as the"Platform"). The Platform is a B2B platform which connects and facilitates sales and purchases of products and/or services between suppliers (or"Sellers") and buyers (or"Buyers"). The Platform is for business to business transactions and therefore is only made available for use by businesses and not for individual or personal use.

This Privacy Policy is an electronic agreement formed under the Information Technology Act, 2000 and the rules made thereunder (as emended till date). This is a legally binding document between the user and Matex. The terms of this privacy policy will come into force from the date on which the user accesses the Platform and will govern the relationship between the user and Matex for all the usages of the Platform by the user. By using the Platform, the user consents that he has carefully read the content of this policy and accepted the same unconditionally.

In this Privacy Policy

    • The terms "We" / "Us" / "Our" individually and collectively refer to entities that are part of the definition of Matex and the terms "You" / "Your" / "Yourself" refer to the users.
    • By providing us your Information or by making use of the facilities provided by the Platform, You hereby consent to the collection, storage, processing and transfer of any or all of Your Personal Information and Non-Personal Information by Matex as specified under this Privacy Policy. You further agree that such collection, use, storage and transfer of Your Information shall not cause any loss or wrongful gain to you or any other person.
    • Information collected and storage of such Information: The Information / data provided by You to Matex or collected from You by Matex may consist of "Personal Information" and "Non-Personal Information".

A. COLLECTION OF INFORMATION

Personal Information - The personal information that Matex may collect about the users broadly falls into the following categories:


Information the users provide to us

  • Users will be asked to provide certain contact information that is necessary for the registering for a Platform account on behalf of a Buyer or Seller, including name, address, phone number, email address, job title and department.
  • Users will be asked to provide certain identity information, tax registration and/or related information about their business, such as their PAN, GST number, business type and industry, corporate registration details and information about the users’ business license, trademarks, patents etc.
  • Matex will also ask the users to provide details about the products and services that the users intend / prefer to buy / sell via the Platform and other details relevant o their purchases / sales.
  • In connection with the facilitation of transactions, purchases and payments over the Platform, the users will be asked to provide certain payment information. This might include bank account numbers, billing and delivery information, tracking information from cheques to facilitate the sale and purchase as Matex acts as the settlement agent of purchase price of the products or services transacted on or procured through the Platform.
  • Matex will process any information provided to us in connection with disputes or to support complaints in connection with the Platform or goods and/or services purchased via the Platform. Please note, Buyers and/or Sellers may submit complaints regarding the products and services on the Platform and/or disputes between the Buyers and Sellers to the Platform and under such circumstances, Matex will process data provided to us by Buyers and/or Sellers that is relevant to the disputes or complaints submitted. This may include information about end the users of the products purchased on the Platform to the extent relevant to the disputes or complaints that are being reviewed by the Platform and to the extent that the individual(s) has provided their explicit consent to their data being shared with us for the purposes of handling the complaints and/or settling the disputes.

Information that Matex collects automatically

  • If the users contact us (such as via our customer services department chat service, telephone or email), Matex may record a copy of the users’ correspondence and may ask for additional information to verify the users’ identity.
  • Matex will collect contact details and other information of the users from publicly available sources for the purposes of verifying such information and performing due diligence on the users.
  • Matex will collect details of the users’ activities, transactions and interactions on the Platform including information relating to the types and specifications of the products and services purchased, pricing and delivery information, dispute and complaint records, communications between the users and any information disclosed in any discussion forum.
  • From time to time, Matex may also collect information about the existing and prospective users, during or in connection with trade shows, industry events and/or other functions. Including representative contact names, addresses, phone numbers, fax numbers and email addresses.

Non-Personal Information

  • If the users visit our Platform, Matex will automatically collect certain information from the users’ device. In some countries, including countries in the European Economic Area, this information may be considered as personal information under applicable data protection laws. Specifically this information may include IP addresses, device type, unique device identification numbers, browser type, broad geographic location (e.g. country or city-level location), browsing patterns and details of how the users have interacted with our Platform and the goods and services available on it. In addition, Matex gathers statistical information about the Platform and visitors to the Platform including, browser software, operating system, software and hardware attributes, pages viewed, number of sessions and unique visitors. Collecting this information enables us to better understand the visitors who come to our Platform, where they come from, and what content is of interest to them. Matex uses this information for our internal analytics purposes and to improve the quality and relevance of our Platform. Some of this information may be collected using cookies and similar tracking technology, as explained further under the sectionE “COOKIES”below.

Information that Matex receive from third parties

  • Matex may receive personal information about the users from social media platforms if the users choose to register for a Platform account via a social media account. Exactly what information Matex receive will depend on the users privacy settings with the applicable platform, but it would typically include basic public profile information such as:

o Users’ name or nickname

o Users’ profile

o Country/State of operation

o Company name

o Contact details


Matex may receive personal information about the users from third parties that are engaged by us to assist with providing verification services and conducting suitable money laundering and KYC (know-the user-customer) checks on the users. This may include the users’ name, email address, company details and contact information.

B. USE OF PERSONAL INFORMATION

Matex may use Users personal information for the following purposes:

  • To improve customer service - Information you provide helps us respond to your customer service requests and support needs more efficiently
  • To personalize user experience - We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site.
  • To improve our Site - We may use feedback you provide to improve our products and services.
  • To facilitate your participation in transactional events - We may use the information Users provide about them to facilitate them to participate in the transactional events on this website. We do not share this information with outside parties except to the extent necessary to provide the service and if called for by Statutory Authorities.
  • To send periodic emails, SMS, and messages through linked sites - We may use the email address / Mobile phone number to send User information and updates pertaining to the transactional events. It may also be used to respond to their inquiries, questions, and/or other requests. If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product, or service information, etc. If at any time the User would like to unsubscribe from receiving future emails / SMS /messages through linked sites, the user may contact Matex.

C. DISCLOSURE OR SHARING OF PERSONAL INFORMATION

Matex does not disclose or share Users personal identification information except as directed by law. No specific information about the user will be shared with any third party unless any of the following conditions is met.

  • To help complete a transaction initiated by the user.
  • The user has specifically authorized it.
  • The disclosure is necessary for compliance of a legal obligation.
  • The sharing is necessary with Government agencies mandated under law.
  • The information is shared with any third party ordered under law.

We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.

Matex may disclose (or provide access to) personal information to the following categories of recipients:

  • Third Parties where necessary in connection with the facilitation of purchases and communications made between the third party and the users.
  • Third party business partners, service providers and/or affiliates of Matex engaged by Matex or working with Matex to assist us to provide services to the users or who otherwise process personal information for purposes described in this Privacy Policy or notified to the users when Matex collects the users’ personal information. Categories of these partners or service providers include:
  • Members of Matex Group and their respective affiliates and/or their designated service providers that work with us to provide processing services such as software, tools, systems, and messaging services for purposes described in this Privacy Policy.
  • Our business partners (for example, for them to provide discounts to the users or offers that may interest the users).
  • Marketing and advertising platforms, such as Google, Twitter, Facebook and Instagram, and providers of analytics services relating to the users’ behaviour, in order to tailor the content, the users see when visiting our Platform. These platforms may combine information they collect on our Platform with data on their platforms and data they collect from other websites or through other sources in order to conduct targeted advertising. The processing activities of these third-party marketing platforms are governed by their own privacy policies, not this Privacy Policy.
  • Payment service providers who collect and process personal information to assist with settling the payments for transactions or process withdrawal requests for Sellers. The activities of payment service providers may be governed by their own privacy policies, not this Privacy Policy.
  • Credit risk assessment providers to conduct risk assessment on Sellers to determine whether a Seller can be permitted to avail a credit line.
  • Logistics partners for providing delivery services for Buyers, including return and exchange of products, and warehousing services for Sellers.
  • Cloud computing service providers to provide cloud storage services.
  • Customer service providers to provide after-sale services.
  • Risk control service providers to assess the security of the users’ accounts and transaction risks; and
  • Third-party rating / reviewing service providers to carry out reviews of our services with customers if the users choose to participate in reviewing or rating of products and/or services offered by Matex.
  • To our professional advisers, law enforcement agencies, insurers, government and regulatory and other organizations where Matex believe it is necessary to comply with applicable laws or to exercise, establish or defend our legal rights or protect the users’ vital interests or those of any other person, Matex may also disclose and transfer the users’ personal information or as otherwise required or permitted by applicable laws.
  • To an actual or potential buyer (and its agents and advisers) in connection with any actual or proposed purchase, merger or acquisition of any part of our business, provided that Matex informs the buyer it must use the users’ personal information only for the purposes disclosed in this Privacy Policy.
  • To any other person with the users consent to the disclosure.
  • Matex may provide aggregated or anonymized data to third parties, but when Matex do so, the information Matex share is in a de-identified format that does not personally identify the users.
  • Links to third party websites are provided on the Platform to facilitate the transactions between the buyers and sellers. Users may please note that those websites are not controlled by or affiliated to Matex. Matex does not warrant the accuracy or completeness of the information, materials, services or the reliability of any service, advice, opinion, statement, or other information displayed or distributed through those websites. Users may be required to submit personal information to register or apply for products or services provided by third parties or co-branded partners. The privacy policies of those other parties may differ from ours, and Matex have no control over the information that the users submit to those third parties. The users should read the relevant privacy policy for those third-party sites and co-branded sites before responding to any offers, products or services advertised by those parties. Matex and its affiliates, subsidiaries, employees, officers, directors, and agents, expressly disclaim any liability for any deficiency in the services offered by those linked websites that you access. Neither Matex nor any of its affiliates nor their directors, officers and employees will be liable to or have any responsibility of any kind for any loss that users may incur in the event of any deficiency in the services provided by those to whom the websites belong, failure or disruption of those websites, or resulting from the act or omission of any other party involved in making those websites or the data contained therein available to the users, or from any other cause relating to your access to, inability to access, or use of the sites or these materials. Whenever users click on the links provided to access those websites, they will be moving away from the secure session on the Platform. Hence users are advised to log out from the secure session on the Platform as a security measure.

Users hereby unconditionally agree and permit that Matex to transfer, share, disclose or part with all or any of your Information, for one or more of the purposes mentioned above or as may be required by applicable law. Matex may also share Personal Information if Matex believes it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of various terms and conditions or our policies. We reserve the right to disclose users’ information when required to do so by law or regulation, or under any legal obligation or order under law or in response to a request from a law enforcement or governmental agency or judicial, quasi-judicial or any other statutory or constitutional authority or to establish or exercise our legal rights or defend against legal claims.

D. SECURITY & RETENTION

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.

Matex shall retain the users’ personal information as long as Matex has an ongoing legitimate business need to do so. For example, to provide services or products to the users, or as required or permitted by applicable laws, such as tax and accounting laws.

When Matex have no ongoing legitimate business need to process the users’ personal information, Matex will either delete or anonymize it or, if this is not possible (for example, the users’ personal information has been stored in backup archives), then Matex will securely store the users personal information and isolate it from any further processing until deletion is possible.

E. COOKIES

This section explains how Matex will use cookies and similar technologies (we'll refer to them collectively as "cookies") to recognize the users when the users visit our Platform. It explains what these technologies are and why Matex uses them, as well as the users rights to control them.

Cookies can also be categorized as session cookies (which are erased once the users close the browser or shut down the device) and persistent cookies (which remain even after closing the browser or shutting down the device/application and which are activated each time the users visit the Platform).

The session cookies use encrypted data to authenticate the users. The persistent cookies do not store account numbers or passwords. Matex use both session cookies and persistent cookies.

Why Matex uses cookies?

Matex uses first and third-party cookies for several reasons. Some cookies are required for technical and/or security reasons for our Platform to operate, and Matex refer to these as "essential" or "strictly necessary" cookies. First party cookies are mainly served to enable basic functionality on our Platform; including web analytics cookies that help us understand how the users use Matex web pages and how Matex can improve their use. For example, Matex uses essential or strictly necessary cookies to enable them to remember goods/services added to the users’ shopping basket on the Platform and to recognize the users when they sign into their accounts with Matex.

In addition to this Matex also uses social media cookies. The users may register for Platform membership and "share" Platform content through social media such as Facebook and Twitter. Sometimes Matex embed videos from websites like You Tube. These websites have their own privacy policies which govern their use of information, which the users can find on the respective websites.

Matex also use cookies to enable them to track and target the interests of Platform visitors to enhance the experience on the Platform by researching visiting patterns and conduct interest-based advertising; assisting our partners to track the users’ visits to the Platforms; and to track progress and participation in promotions. Matex uses first and third-party cookies for these purposes.

How can users control cookies?

The users can determine if and how a cookie will be accepted by configuring the privacy setting of the browser the users are using to access the Platform or the "privacy setting" of the users’ device. As the means by which the users can refuse cookies through the users’ web browser controls vary from browser-to-browser, the users should visit the users’ browser's help menu for more information. Matex has the discretion to update this Privacy Policy from time to time in response to changing legal, technical, or business developments. When Matex updates its Privacy Policy, Matex will take appropriate measures to inform the users, consistent with the significance of the changes Matex make. Matex will obtain the users consent to any material Privacy Policy changes if and where this is required by applicable data protection laws. We encourage Users to frequently check this page for any changes to stay informed about the changes to this policy.

Your continued use of the Platform or provision of data or information thereafter will imply your unconditional acceptance of such updates to this Privacy Policy.

Any changes to this Privacy Policy will be communicated by Matex by posting an amended Privacy Policy on the Platform. Once posted on the Platform, the new Privacy Policy will be effective immediately. The users can see when this Privacy Notice was last updated by checking the “last updated” date displayed at the top of this Privacy Notice.

G. YOUR ACCEPTANCE OF THESE TERMS

You hereby accept and represent to Matex that:

  • The Information you provide to Matex from time to time is and shall be authentic, correct, current and updated and You have all the rights, permissions and consents as may be required to provide such Information to Matex.
  • Your providing the Information to Matex and its consequent storage, collection, usage, transfer, access, or processing of the same by Matex shall not be in violation of any third-party agreement, laws, charter documents, judgments, orders, and decrees.
  • Matex and each of its entities shall not be responsible for the authenticity of the Information that You or any other user provide to Matex. You shall indemnify and hold harmless Matex and each of its entities and any third party relying on the Information provided by You in the event You are in breach of this Privacy Policy including this provision and the immediately preceding provision above and hereinafter.
  • Your Information will primarily be stored in electronic form however certain data can also be stored in physical form. We may store, collect, process, and use your data in countries other than Republic of India but under compliance with applicable laws. We may enter into agreements with third parties (in or outside of India) to store or process your information or data. These third parties may have their own security standards to safeguard your information or data.
